The poor SUV driver from the surveillance video, witnessed the whole thing. There was also a worker from the nearby landfill who watched it all unfold from up on the landfill.

In that second link, right at the end, a big flatbed goes by on the road and then seems to hit his brakes to come to a stop right on the tracks.

Its a sad thing that happened.
But...The kid driving broke the law. Plain and simple.
But sumpter's right..The news report makes it sound like its all Amtrak's fault. I'm sure the families of the victims already have lawyers lined up waiting to sue. They might of had a case, if there wasn't a video showing them speeding through or two witnesses.
For once..I'd like to see a railroad sue the for damge to the loco caused when they broke the law, and went through a guarded crossing.
Especially, when there's already video showing they did.

The real sad part...Amtrak and NS will both be sued, and will wind up paying damages.
If the engineer was going over their speed limit or under the speed limit they will win. The reason being this: If the train was going under the speed limit he was at the crossing late and had the train been through the crossing, the crash would not have happened. Same logic applies for over speed.
If you think this is outrageous, you are right, but Conrail lost one with this reasoning. No judge should let any suit be filed here, but when you can win big by dumping McD's coffee in you lap, you can expect anything.
